My application date is 30th april 2013.

Please confirm whether the below is correct.

Year1 30-Apr-13 to 1st May 2012
Year2 30-Apr-12 to 1st May 2011
Year3 30-Apr-11 to 1st May 2010
Year4 30-Apr-10 to 1st May 2009
Year5 30-Apr-09 to 1st May 2008


The PDF examples shows different and bit confused.

Please clarify.

You have to write the other way round. Are you trying to prove your continuous residency? Is it asked in the SET O Form?

HI Kevin,

Can you explain how differently should it be written as even I am preparing my application in the same way as above? This is required for detailing absences for each 12 months period in the absence letter (i'm yet to fill my form so don't know if its asked there too)

A single absence from mid feb 09 until mid sep 09 (7 months) is broken across 2 years feb/09 till 30/Apr/09 in Year 1 and 1/May/09 till sep/09 covered in Year 2.

Application date s 01/May/2013.

Is this OK?

Don't go to prepare complex tables for your absences. Keep it simple. CW will know exactly how many days you were absent from UK,By inputting your passport details.

If you look at the SET O Form it's very simple to fill in the dates.You need to total the absences and explanations regarding year 2 and year 1 from your Employer. Your table is fine.This could be done in an Excel sheet..

Yes, the above one is a snippet from excel.

Between all absences that my employer has provided in a table format, one of the line is for 07/feb/2009 - 07/sep/2009 with reason mentioned as Business Trip.

Apart from this the employer has mentioned that all business trips were authorised, approved and paid for. (I was paid in India during the above period and other smaller business trips within europe were paid in the UK)

I hope that should suffice?

That's good. Don't mention in the letter that you were paid in India at any time.

Mate! You need to add the total No. of absences on your Excel table.

Table is Fine. One Correction start with Year 5(April2013-April 2012) and Go to year 1. You need to add up the Total Absences.

O.K. You are trying to proove your 5 year continuous stay in the UK. If your Appointment is on 1st of May,shouldn't you be doing the Table e.g 1st April to 30th April for each 5 years. Then you could include your No. of days of absences too.

This is extracted from the continous period calcuation pdf of ukba.

The absents should also be calculated based on the 5 years period only.

My appointment is on 30th april 2013.

So i have calculated my absences based on that.

O.K. You are trying to proove your 5 year continuous stay in the UK. If your Appointment is on 1st of May,shouldn't you be doing the Table e.g 1st April to 30th April for each 5 years. Then you could include your No. of days of absences too.

Kevin you say that the 5 year period should start from the date of application, however if someone is applying 28 days before completing the 5 years then they cant back date his entry clearance or can they??

for eg ..if you got the tier 1 visa on 10th of June 2008 expires on 10th of June 2013..and you are applying for the ILR on say 2nd of june 2013.

2nd June 2013 - 1st June 2012
2nd June 2012 - 1st June 2011
2nd June 2011 - 1st June 2010
2nd June 2010 - 1st June 2009
2nd June 2010 - 1st June 2009

So you can clearly see that you were not in the country on 1st of june 2009.

I think the periods you have listed are correct based on your application date. The question is whether to list the years (in descending order) as 5, 4, 3 ,2 1 or 1, 2, 3, 4, 5.

Honestly, I dont think this matters and they will even bother about it as long as other informaiton (year dates as per your application date) and absences are correct.
