Visa refusal Tier 1 dependant - Husband on ILR

Hi,

I have been living in uk with my husband for 5 years now. But my husband applied for my Tier 1 dependant visa as I had not passed Life in Uk test.
This Tier1 dependant visa has been refused due to maintenance funds.

Now I have passed Life in Uk test as well, which is good thing.

My question is can I make a fresh application for ILR now within 28 days now.

Please reply as soon as possible as 10 days have already passed and I have also booked PEO appointment for 9th May.

Is that ok or should I apply by post? also my passport has been retained by UKBA
?

What is your current visa status ?

I am assuming you are on t1 depended, that you are eligible for ILR except for LIUK failiure and hencec applied for t1 dependent, and your husband has ILR now?

If yes, you can definitely apply for ILR.

My husband is on ILR.
yes, I am on tier 1 dependatn visa which was expired 7th december 2012.
And my husband applied for my Tier 1 dependant just before my visa was going to expire. Only reason was that at that time i did not pass life in uk.

And now I have got refusal and passprot retained by UKBA.

And i am planning to make fresh application for ILR within 28 days of refusal . Also I have passed Life in uk test and eligible for ILR.

So i am taking that i can still make fresh application although visa is expired by that was with UKBA anyway??
is that correct?
