Variation from FLR(M) to SET (Long Residence)

My wife completes her 10yeras in the UK on 04/06/13.

She applied for FLR(M) on 12 as her visa were expiring on 13/04/13.

However due to bank's error fee payment did not go through.

Following letter from HSBC on dishonoured cheque she sent a second cheque and a form FLR(M) on 01/05/2013 with cover letter to link the payment with first application.

Mean time home office issued a letter on 29/04/13 and returned all the documents back to us with first FLR(M) saying invalid.

The second cheque and form has not yet been acknowledged by UKBA until today 09/05/13 . Only the cheque has been cashed today as per my bank statement.

From today 09/05/13 only 25 days left for her to complete 10 years here in UK. As I understand 28days before one can apply for FLR(M) can she submit variation application now.

I am bit concerned about the invalid application and her last visa expiry on 13/04/13. If we calculate from 13/04/13 the gap for her 10 year to complete is about 50-52 days.

Can senior member please advise how to go about her variation to ILR(long residence)
