SOC code

Hi All,

I have a question regarding SOC code.

I am currently on WP, EC issued in June 2008 and entered UK July 2008. I booked PEO appointment for 31st May. Since July 2008 i am working for the same University where i work as Research Technician. Now that i need to write my SOC code best describe my job; basing on this my close matching SOC code is in PhD level jobs (i think i can not choose it because i dont have PhD yet).

So, i decided to choose SOC 2010 code : 3111 (laboratory technician). which falls under NQF level 3. Now my question is: Am i allowed to apply ILR with NQF level 3 job ??? or my should be above NQF level 6 to apply.

Please let me know.

New SOC Code list gives Jobs above NQF Level 6. Can't yo find any thing a nearest match to your current job.

My suitable code is 3111, does this cause any problem??????

Thanks Jevin24,

I choose SOC code: 2119, listed under occupation skilled to PhD level, since i am nearly finishing my PhD and most of my job task match with this.

I am safe with regards to salary requirement.

Any inputs?

If the Employer will give the letter Indicating SOC Code 2119, You should be fine. As salary requirement is O.K.

Just had a chat with my HR, she said she can only give me letter with SOC code 3111. (NQF level 3).

Can i get ILR with NQF level 3 job? In terms of my salary i am well above the minimum they state

Please let me know.

Hi! Anil,

When the New SOC Code clearly says that jobs should be NQF Level 6.from 06/04. o if you mention a SOC Code at NQF Level 3 ,will lead to problems. If I were you I will omit the SOC Code show only the salary. Can't you wait till you finish your Phd and apply for ILR. Extend your visa until you finish your Phd.

When the New SOC Code clearly says that jobs should be NQF Level 6.from 06/04. o if you mention a SOC Code at NQF Level 3 ,will lead to problems. My visa expires 18-6-13, to finish PhD it still take a bit of time. But, haver a look at this.This is what they say in code of practise.
For Occupations skilled to NQF level 3" Tier 2 applicants can only be sponsored for jobs in these occupations if:
 the job appears on the Shortage Occupation List, or
 the applicant is currently in the UK under Tier 2, and has been in Tier 2 since before the changes
made on 6 April 2011 came into force, or
the applicant is currently in the UK under an old immigration category that was replaced by Tier
2, such as work permit holders.


According to this, i am on old WP and currently in UK, suggesting i can get Tier2 sponsorship, I think

I haven't seen any rejections on similar issue. But your argument sounds good. If you are going for a PEO appointment,you should be able to argue your case with CW. So you will need your correct facts to argue. I think it would be adviseable to get an advise from an Immigration Advisor,on this issue.Before you apply Postal/PEO basis.

Thanks for the reply. I am going with PEO appointment on 31st May. Before that, i will try to get advice from Immigration advisor. Whom should i contact, can i just phone HO and ask for advice????

Some times UKBA give confusing advise. Since the PEO date is close,you cannot go for a SCS service. My advise would be to get a Solicitor( where your friend could recomend) and ask for advise. You could try UKBA and ask for advise. Get a solid advise,some times CW don't like arguments,but if they are not sure they will refer you to the senior CW. Take all the Paper work to argue your case. Which PEO are you going to?? Good Luck.

I also went to Solihull PEO. What the CW did after taking the payment sheet,was to print the new SOC Code. Then she checked with Employer's letter SOC Code and salary.After that Pay slip and Bank Statement, and other documents before approving My ILR.Like I advised you please get good advise and take all the paper work to argue your Case. Because there are refusals coming form Solihull too,now a days.

I just phone one of the A.Seelhoff Solicitors, asked them regarding the SOC code and it falls under NQF-3. He said since i am on old WP, if the salary if above the min. requirment , that should be fine.

He said HO is not too picky about the code you use for the old WP holders.

Keep fingers crossed for 31st May.

Old WP ILR don't need to show NQF level 6 job. Level 3 will be fine as long as you earn above what mentioned in the relevant SOC code. My one is approved last month without any question.

Further can be read in page 38 to 42.
