ILR eligibility | 9 months out of country

Hi All,
I came to this country on 4th of Feb 2007 on WP. I worked until 31st of Aug 2008 and went back.
Came back on 24th Nov 2008 and worked until 31st Aug 2009 and went back, this time a for a little longer.
Came back on 5th June 2010 on Tier-2 General and transferred to Tier-1 General on Jan 2011, got my Tier-1 extension for 3 years in Jan 2013.
According to new rules, I have not been out of country for more than 180 days in any calendar year.
Am I eligible for ILR or shall I wait for few more years as I have already got Tier-1 for another 3 years. Only reason I want to do it is for the reason I don't have to worry about how much I earn during a particular year.
