ILR Application_ Absence from UK

Dear All,

Please advice me on this.

I married to a British Citizen and I'm on a 2 year spouse visa which will expire on 15 Jan 2015. As per UKBA guidelines I will be able to apply for ILR after spending two years on spouse visa. However, I am planning to go to India for my delivery on 20 October 2013 and come back on 20 April 2014. This will exceed 180 days absence period. Please advice me if i still be qualify to apply for ILR even if i return to UK after my 170 days continuous stay in India. Please advice me on this

The is no requirement to be in the UK per se. However, you must justify any absences, being absent due to cultural/family reasons to give birth should be justifiable.

Also, they may want evidence of subsisting marriage, including during the separation period.
