19 days shorter for 5 yrs duration (Tier 1 general), Help!!

Hi

I'm worried about my total 5 years duration time which is mandatory for ILR visa, cos i calculated my visa dates and found that i have been granted less than 5 years ( from starting date to expiry date ukba had issued me only for 4 years 11 months 13 days, 19 days shorter for 5 years duration ). now im confused what to do and whom to contact
or is it a normal situation

below are the dates

1st time visa granted on 12-AUG-2008 TO 24-JULY 2011
EXTENDED ON 20-JULY 2011 TO 24-JULY-2013

i calculted the days using http://www.timeanddate.com/date/duration.html
including the last day(24-july-2013)

I wrote letter long back to endorsement errors dept. who deals with errors on the visa stampings,....no Luck..no reply :(

Does anyone know or faced this situation.

please advice me

Sorry, what is the problem?

You can apply for ILR 28 days before your 5 year anniversary.

do i need to count the 28 days before the expiry of visa or 28 days before the anniversary,

I was thinking that i should have total 5 years visa to apply for ILR, But my visa was granted only for 4 years 11 months and 13 days which makes 19 days shorter for 5 years

You can apply approximately after 4 yrs 11 months and 5 days after your initial grant. So you should be ok.

Similar query

Ofcourse you must apply before your current visa runs out, no later.

As I am understanding it, instead of the end day as it is on the Visa, You can apply for the visa, 28 days before the 5th anniversary from your 1st grant.

If your 1st entry was within 3 months of getting the visa then you can apply 28 days before of the 5th anniversary (ILR eligibility date).

Hi all

A similar case of first Tier 1 visa being shorter than 3 years, would very much appreciate your thoughts and comments…

1st Tier 1 (General) visa granted 1 January 2009
Entered UK 31 January 2009
1st Tier 1 expired 05 November 2011 – 2 months short of 3 years
2nd Tier 1 visa is to expire on 2nd December 2013

I’ve read through info on the forum and UKBA homepage and based on that calculated that I’m eligible to apply for ILR on 4th December 2013 – 2 days after my visa expires…

Do you think I stand a chance of success, if I apply for ILR quite late in November this year?

I suggest not to apply in November

Thanks ukba2536. Was thinking to attend PEO.

While it's clear that I have to apply before my visa expires, I also read that breaks in the lawful residence period may apply if the application for ILR made no more than 28 days after the expiry of the previous leave (from Calculating continuous period in the UK).

So, wondering, if I make a late application, after the visa expires? It's a huge gamble I guess, but 2 days' shortfall is just so annoying!
