Could you please help me out with following query. Many thanks in advance for your help.

If a Tier 1 General Dependent in UK is not eligible for ILR/Settlement, Can they apply for further leave to remain/visa extension under Tier 1 General Dependent category at the same time and together with Tier 1 General main applicant who is applying for ILR/Settlement? Can they apply together by PEO same day service?

Basically, I am on Tier 1 general visa and will qualify for ILR/Settlement in July,2013. My wife changed her visa from workpermit to Tier 1 Dependant migrant visa in October 2011 and she doesn't qualify for ILR/Settlement as she would be short of few months of staying on 2 years dependant visa of main applicant, although she entered before me through her Work permit in August 2008.

Can we apply ILR/Settlement under Tier 1 General category for me and Tier 1 General Dependent visa extension for my wife together at same-time/same-day with a single PEO appointment? What are the risks? what is the safe bet, I also got a UK born kid what visa should we apply or should I wait for my ILR and register kid as BC.

When is your wife's dep visa valid until? Once either of you are settled your child is entitled to register as a British Citizen under section 1(3) of the British Nationality Act.

The visa is expiring on the same day for all of us on 5th August 2013, I wish to go for PEO on or after 22nd July as my salary gets credited on 21st of the month so I can include Julys salary as well.. but because it is so neck to neck.. I just wanted to check if this is possible to go for PEO rather by post..

Yes you can extend your spouse's pbs dep visa at the same time then once she has qualified (2 years) she can apply for settlement on form set(o). Once you're settled (granted ILR) you can register your child as British on form MN1.

Just a quicky one what do you think how much should be the time difference between the Primary and dependant appointment time if I wish to go for the same day and in same PEO. I called UKBA and they say that the safer bet is to do in 2 different dates as some times if the CW is not able to decided on primary applicants ILR then you would loose the appointment fees.
What do you suggest ?

Ideally a couple of hours apart, as i have advised in your other post.
