Hi, I am having problems with when to apply for ILR.

Here is my case.

Tier 1 visa : 5th January, 2009 to 5th January, 2012
Entered UK: 28th Febuary, 2009

Extension: 16th February,2012 to 16th February 2014. There was a gap because I did postal application and took some time for decision.

No absent from UK at any time.

So, should the 28 days start from:

1. 5th of January which means I can apply from 9th December, 2013
OR
2. 28th of February which means I can apply from 31st January
OR
3. 16th of February which is the expiry date of my extension.

I will appreciate your response.

Since your 1st entry was within 90 days, therefore, the point 1 will relate to your case. Moreover, do not worry about the period that was spent under applications process as in time valid applications trigger Section 3C which extend the existing leave till decision. Best of luck.
