The best way to prove good charater.

Hi all,
I am due to apply ILR in this July.
I had couple of arrests in family matters now they all were spent ( 24 months provision)according to the immigration rule changed in 13 Dec,2012.There is no court involvement at all.
But I am worried about the refusal of my ILR application under the ground of good character due to a series of arrests and investigations made by police.
Should I still claim that I am in good character or not ? . I can meet all the criteria as per point based system other than a law biding person.
I am working as full time too.
Do you think any kind of letter from the community people regarding the character would help or it would just add further complication??
I am now worried much as the application date is coming very soon. I've been to couple of solicitors, unfortunately couldn't get anyone who had dealt already such cases. Anyone would you please guide me if someone you know who already dealt like this case successfully???Cheers!
Thanks for your sharing.

Hi D410..,

As per police national computer report ( PNC)

1st,

May 2011
Disposal ( Caution)
Offence description : Destroy or damage property value less than £ 5000

2nd

May , 2011
Disposal ( Court )
Penalty Notice
Offence description : Use disorderly behaviour( drunk ).

3rd

Sept, 2011
Disposal ( NFA-No Further Action )
Offence type : Sending a letter or other article conveying false information.

I am due to apply in July now.I know third one is no further action so anyone can be arrested for a suspicion and released after an investigation. So no impact on 13th Dec,2012 rule. But am worried about a discretionary on the good character background.
Any help please?
I am looking for someone solicitor who is very known about it.
Cheers for your help.

Any idea fellows !
Should we submit the character reference at the first time ??.Because I dont have any non spent conviction but some repetition ...
If they refuse on the ground of good character so they give the chances to proof the good character ??
Any previous information/outcome please ?

You shouldn't face mandatory refusal given the time. However you could be viewed as a repeat offender. Although, given that two incidents occurred during the same month perhaps write a letter explaining the circumstances and there have been no further issues.

Dear Guru D410,

Thank you for coming back and good advice.I will write all the matters .Previously when I asked for a CRB check for a CRB related job they ask me for some character reference from the community to get the license once I submitted they provide me the license . So here also I am confused if I should submit the reference letter with my application? If I submitted it would be too much complicated ??.And
If not submitted they might refuse on the same ground asking reference letter and waste of money/ time so need of some more advices/brain storming please ??

If you are worried than get a reference letter from your employer and maybe a teacher from school/uni who knew you best. Letters from friends as well. (I submitted some reference letters to show "ties to the UK". My lawyers advised me to attach with each letter copy of the referee passport and UK visa if applicable - that's only for friends.)
Do some community/volunteering work as well.

Given the fact that you will have two referees who are vouching for your character (one being professional) there shouldn't be a need for further references. Given the nature and gravity of your offences you should stand a greater chance of success. If you had an alcohol problem (and thus the offences resulted from that) then perhaps evidence that you sought some treatment or that you no longer have this issue would be beneficial.

Guru,
Thank you for your suggestions. Its very hard to ask someone for a reference letter because I have to disclose all of my offences in the community until and otherwise it is necessary. So am thinking to avoid if possible .Any idea please ?. If the case worker give me the chance to submit again that would be OK, but my worry is they may not provide the chances and refuse straight way.
Regarding the vouching nobody is doing so now.
Cheers

The references I was related to we're when you go for nationality. Just write a letter yourself explaining the situation and that there has been no further convictions or trouble.

Hi Londener,

I do not have any offenses.
I just have a complicated case with gaps/overstays etc, so I was advised to submit some reference letters alongside with my postal application (10 year route). I have not had any questions or my documents back yet (no decision has been made for me yet)
