Hello
I am tier 1 valid until Nov 2014. I am eligible ILR on long residency on August 2013 and Tier 1 ilr on June 2014 .
My wife is with me more than 5 years as dependent. My uk born child has no visa on his passport(Not applied on my extension last year).
My wife wants to travel back home during my long residency ILR application .Can she travel during my passport on home office ? Also , can she back UK when I got ILR
My child also traveling with my wife .This month I will apply dependent visa for him.
Any suggestion ?
Thank You.

Will her visa still be valid? Can't see it being an issue if so, and if she's not applying for anything herself at the time.

Once you are settled (have ilr) your child will be entitled to register as a British Citizen by virtue of section 1(3) of the British Nationality Act. It may be a good idea if you wait and apply for PBS ilr and your spouse can apply at the same time for her ilr. With a long residence visa your spouse will have to change visa. It might be wise to all stay in the UK until settled as its more costly, extra visas (unnecessary) for your child.
