Hi Everybody,

I'd like some advice on my immigration matter. Some details:

I came to the UK in October 2003 on a student visa, extended various times until May 2007 when I tried to convert to a dependent in-country but was refused along with my wife.

My visa expired on May 31 2007 but I received my refusal around June 30 2007. I immediately got a lawyer to reply to the HO using something called the one-stop rule within ten days and later reapplied as a student again in my own right in August 2007.

This application was subsequently approved in October 2007 and I am now on a second leg of my Tier 1 General visa due to run out in 2016. I wanted to apply for ILR based on 10-year rule but am a bit skeptical as I could be deemed to have had a non-countinuous break in my residence.

Can anybody please clarify my situation for me? I don't know if anybody has had a similar situation or others might benefit from your kind and assured responses.

Did you appeal the refusal?

No I did not apply the refusal. The lawyer just asked for disposition for me to reapply as a student and they accepted my new application without any fuss and this was approved.
