Advise Required on Dependent (ILR) - 10yrs

Hi,

I am very much new to this forum and would request your valuable advise on dependent ILR.

I received my ILR on 10yrs this April, 2013. I have applied for my sons nationality and received British passports this week. Now, I need the advise that my wife came to this country as a student dependent on Sept., 2003. Later, switched to Tier-1 dependent in March, 2009 and got extension in May, 2012. Her visa is valid until May, 2014.

Kindly please give advise whats in her best interest. Could she directly apply for ILR using which form?. If not, what other formalities she need to complete to switch her visa status. I earnestly request advise in details as I have no idea regarding immigration and can't afford to see a solicitor.

Two options, she waits until she has 10 years continuous and legal residence and applies for set(lr) that would be September 2013 assuming no breaks. If not she can apply flr(m) and once granted should be able to apply for set(m) assuming she meets the other requirements.

Unfortunately, she can't apply under 10yrs rule as she got breaks. If she applies FLR(m) can she do it SET(m) on the same day? Do she need to pay the HO fees in double? Please explain.
