ILR QUESTION FOR FRIEND

Hi all ,
One of my friend call me today for ILR query

1. he got tier-1 general in july 2008 , he order 5 yrs HMRC History.

Now question is in HMRC letter it says
2008-2009 NO RECORD FOR NI CONTRIBUTION
2009-2010 CLASS-1 & CLASS-2
2010-2011 CLASS-1 & CLASS-2
2011-2012 CLASS-1 & CLASS-2
2012-2013 CLASS-1 & CLASS-2

My friend is very depressed as his previous employer is probably not paid his NI & taxes but he had P60 from 2008 as His Employer didnot pay Ni or any taxed .

Will it be problem for him..

I really appreciate your answer , he said he allready booked appointment in july begininng.

Call HMRC and tell them that there is no NIC recorded for 2008-2009. They will ask you to send a copy of P60. Do so. They will correct it. They did for me.

Actually my ILR was refused for this very reason.

Just wanted to check with every one what is the worry if someone is on Tier1 do they have to earn for all the 5 years, what if someone didnt get any job for first 2 years and then they found a job as most of us who would apply would have come during recession and finding a job from Sept 2008 to Sept 2009 was very tough.. just wanted to check with everyone what is the rule is the concern is why the tax not paid or whether someone has to be working for all the 5 years ?

As per my knowledge T-1 (g) don"t require to work all 5 year throughout I can confirm now because I ask one of visa officer at british high commision in India, As he is one of my friend.
