Confusion regarding annual income for ILR

Hi All,
I am applying for my ILR next month and wanted to find out that in my last 4 years pay was above 40k on P60 and payslip as well but last year in march have change to umbrella company as they are paying expenses and all my payslip total is more than 40k including expenses but on my P60 they have deducted expense my annual income so this year my on P60 is under 30k so on SET (O) Form what do I need to select £29,000k-£31,999 or £40000 +.
Please Help ?

well depends on how many poins you need for ILR and how many points you are getting if you choose one o fthe other income thresholds!!

if i claim £29,000k-£31,999 Then I will get 75 Points and £40000 + than 90 Points.

well how many points do you need to be qualified for ILR?

You can only include allowances if they are mentioned as part of your remuneration and specified as such on your payslips. I am guessing that this is not the case, your umbrella has not shown these as part of your salary to make your earnings more tax efficient. So you will only be able to claim points for the figure on your P60, ie 29 to 31K

Hi Pratikshah2008,
With the use of an umbrella company, your proof of earnings is not as straightforward hence leading to this confusion. May I suggest that you consult an accredited accountant for advice and acquire a proof of earnings in writing to further clarify and support as evidence of your previous earnings?
Also, as stated at the bottom paragraph of pg 27 of the Set O form, you need to demonstrate your earnings with 2 pieces of evidence from 2 separate sources that corroborate, eg. payslips and P60s are considered as one source.
