ILR Number of days allowed outside UK 4 work permit holder

Hi,

I have a work permit which was provided to me on [b]24th February 2009[/b]. According to the new rule one can spend 180 days in each year during the five year period (i.e in total I can spend 180 X 5 = 900days outside UK). However, the old rule only allowed 180 days in total 5 years period.

My confusion is because I was given this work permit on 24th February 2009;

1) For getting ILR, do I need to follow the old rule that applied at the time of my work permit or the new rule?

2) As of now I have spent 180 days outside this country and this includes 8 days unpaid leave. Is this a problem? Please note remaining holidays were either paid leave or bank holiday.
