ILR dependant visa (family settlement) from India

Hi all,

Me, along with my wife and our first son were granted Indefinite Leave to Remain (ILR) last year in October 2012 in the UK.

My wife delivered our second son in July this year in India and would like to apply for family settlement visa for him.

I have couple of clarifications:

1. Which appendix should we fill in - Appendix 1 or 2?

2. As both parents of the applicant are settled in UK, do we have still meet the financial requirement?

STATEMENT OF INTENT: FAMILY MIGRATION date June 2012 says:

Section 128.6 - Parents and Children - A child joining parents who both have settled status in the UK will not be subject to the financial requirement (income threshold) and will continue to get settlement on
arrival (indefinite leave to enter)

Is the above statement valid anymore - as I am not sure from when financial requirements rule has come into effect.

Please could someone confirm the above?

Appendix one and no financial requirement but rather adequate maintenance and accommodation, may be required to sign an undertaking.
