Hi my wife has been in the UK for over a year on a spouse visa which ends in August 2014

She needs to apply for indefinate leave what is the procedures and requirements?

Does she need to do a english test and how far in advance should she prepare?

We have one son who is now 5 months mashallah and I work but wife doesn't

I know we still have 10 months to go but I want to prepare in advance

Everything is available on UKBA site and if your wife has degree which has been taught in English so there is no need for B1 test but she has to pass life in the UK test .

I assume your wife was granted leave as a spouse sometime in May/June 2012?

Make sure you are collecting cohabitation proof which is one joint letter or a letter each for every 4 months since she has arrived from a total of at least 3 different sources.

If she had applied prior to 9 July 2012, then she would be subject to the old rules.

You mean the original application for spouse visa this was made in 2011 May time what does this mean am I worse off?

Also what is B1 test?

Ok thanks I have been reading on the UKBA that my wife has to do a B1 test and the life in the UK test as we have now missed the date of October 2013 when B1 is required

My next question is where do I find a approved test centre for ESOL exam we are in Scotland

She doesn't need the B1 test, only the Life in the UK test as her visa was issued under the old rules. Have you clicked on Vinny's links?

(B1 or alternatives) and Life in the UK test are also required for KOLL, if applying for settlement.

Yes I have I don't quite understand what they mean

My wife did a ILETS test and passed she came UK last year in 2012 and we applied way back in May 2011

So does she only have to do the life in UK test and not the B1 test?

I have been reading through the link and still not sure if she need I do both or just one test?

Anyone applying for settlement or naturalisation will need to meet a B1 English requirement in addition to LIUK unless exempt. Hence, does the applicant have a degree taught in English?

An expired IELTS can be used to meet the B1 requirement.

Hi, If your wife doesnt have a degree taught in english AND certified by UK NARIC then she has to give an english test. The list of approved tests is given in the UKBA site. Its a must for everyone to give Life in UK test regardless of teh launguage.
I myself have submitted these documents recently for my ILR.

Yes it doesnt matter where she passed it. It should just be valid and not expired.

Only if it meets or exceed Level B1 of the CEFR. Don't forget, you only needed Level A1 for the spouse visa whereas for ILR, you need to achieve a Level B1.

So make sure she has a score of at least 4.0 in both speaking and listening. The reading and writing score is irrelevant.

This is incorrect. You don't need a B1 test if you were applying for ILR before 28 October 2013.

Applying after 28 October 2013 for ILR, you need both B1 test and Life in the UK test.

Hi, first of all thank you all is a really useful forum.
I will apply for ILR first week of Feb 2014 using a SET(O) from a Tier 1 general.

I've completed my 5 years in the UK, I've never been more than 180 consecutive days abroad. but:

- I was 92 days abroad in the following conditions: I was in mid terms from London School of Marketing finished in Dec 2010 and my next term started Feb 2011. I finished working for a company in Nov 2010 so my wife and I went to visit our families and sort out few things in our country in that mid term. We registered before we left in the police that we intended to came back by Feb 2011. After I started to work as self employee and keep on with my studies.

What docs you suggest I should bring to justify my absence?

Does my wife have to probe her absence as well?
