Please advise

Hi,

I would like your advise on the matter below

I have been in the UK for just over 10 years and I do qualify for SET(LR) although am on a tier 2 general and can apply for ILR in 2015. I currently have my husband as a dependent and a baby born this year for whom we have not applied for a dependent visa yet.

My husband has been here 11 years as a student (6 years) then post study work visa (2 years) and eventually as my dependent in last three years. So for part if his 10 years to qualify for set Lr he has been my dependent. What I would like to know is whether my husband can make his own application for SET(LR) despite being a dependent at the moment?

I was on a student visa (5years) then PSW (2 years) and tier 2 general in last three years.

Your advise will be appreciated!

Both you and your husband may make separate SET(LR) applications, if you have both spent 10 years legally in the UK.

A UK born baby is not required to make any leave to remain application. Just register him/her as a British citizen after a parent is granted ILR.
