Hi. My friends have discretionary leave to remain for 3 years and they are due to apply. Leave to remain. Question is will they apply for ILR or extension. if one member is having conviction can it affect the whole family if they make joint application

What was the basis of Discretionary Leave?

See also Discretionary Leave - what to do.. Note that ILR is subject to criminality threshold.

Details regarding the conviction would help, e.g. Custodial? When sentenced? Offence? First offence?

Assuming a non-custodial sentence, s(he) should be ok for an extension and in another 3 years (or technically 24 months after conviction) will hopefully be ok for ILR providing no further criminality.
