Spouse Visa Questions

Hello...
I had got an ILR status in JUN2011 and married NOV2011. applied a spouse visa for my wife and got received DEC2011. She came to the UK in JAN2012. Her visa will be valid till MAR2014.

As per the UKBA website my wife will be eligible for ILR in next extension (according to before 8 July 2012 rule).

I have following questions.,

a)evidence of your age and your partner's age
We both will submit our passports, will it be enough to prove our age?
b)your marriage or civil partnership certificate
We have our marriage certificate which we submitted when i applied for her visa first time. shall i submit the same again?
c)evidence that you were both free to marry or enter your civil partnership, if either of you was previously married or in a civil partnership
what documents i have to submit?
d)evidence that you have met
what documents i have to submit?
e)evidence of your English language ability - see the English language page
She taught her bachelors in english and which we submitted when i applied for her visa first time. shall i submit the same again?
f)evidence that you can can maintain yourselves and any dependants adequately without needing public funds - see the Maintenance (funds) page
Is there any minimum funds we should maintain? we both getting around £600 a month each. will it be enough to prove?
g)evidence of your accommodation
We can provide Tenancy document from DEC2012 to till date. before we were living in shared accommodation no documents to prove. will it be enough or provide documents for complete 2years?
h) any other documents we have to provide to UKBA to get her ILR? please advice.

I shall answer all your queries with answers appended below your questions;

This is applicable only if either of you were married before (In which case submit the court order/divorce judgement) if not ignore.

Since you fall under the before 8 July 2012 rule no amount limit as such. You will have to show that you can sustain yourselves during a 2 year probationary period since you are in UK.
Evidence to be submitted:
To meet the maintenance requirement evidence must be provided that demonstrates:

sufficient independent means; Bank statements covering the period
employment for one or both of the parties; Employment letters/contracts if already employed
and
sufficient prospects of employment for one or both parties. Job offers/adverts/mails from recruiters/agencies

g)evidence of your accommodation
We can provide Tenancy document from DEC2012 to till date. before we were living in shared accommodation no documents to prove. will it be enough or provide documents for complete 2years?

Will do. The tenancy agreement would suffice along with bank statements for two full years.
h) any other documents we have to provide to UKBA to get her ILR? please advice.

ALL DOCUMENTS REQUIRED AS BELOW:
2 recent passport photographs and your passport - see the Photographs and passport page
evidence of your age and your partner's age
your marriage or civil partnership certificate
evidence that you were both free to marry or enter your civil partnership, if either of you was previously married or in a civil partnership
evidence that you have met
evidence of your English language ability - see the English language page
evidence that you meet the financial requirement.

a) Evidence that you have met (any documents are required for this?)

b) We have Joint bank account and we can provide 24m statements and Tenancy agreement for living. Except these two unfortunately we don't have any proofs that we can show. will these proofs are enough to prove we both are living together?

Are you sure you're applying on the SET(M) form? You appear to be reading FLR(M). :?

Hi Casa,

Thank you very much.
Yes you are right. i was reading FLR(M). actually my wife is going to be eligible for ILR (this extension). therefore she has to use SET(M) form.

Please can you guide me, what are the requirements for SET(M)? i can't find any detail information for SET(M) in UKBA website.

Thanks Amber.

According to SET(M) form we need to show quite lot of documents for evidence! is there any rule which over come who got entry clearance on or before 28 Jul 2012?

should they show evidence of the following documents?

We need 6 letters or other documents addressed to you jointly or in both your names. If you do not have enough
items in your joint names, you may also provide items addressed to each of you individually if they show the same address
for both of you.
For example – 4 items of correspondence in joint names to the same address and 2 items addressed to each partner at the
address. In total 8 items will need to be submitted.
If you and your partner have no bills or correspondence in joint names you will need to submit 12 items (6 each) of correspondence, evidencing that you reside together at the same address.
Examples of acceptable letters and documents are listed below. They must be originals.
The dates of the letters or documents should spread over the whole 2 years. They should be from at least 3 different
sources.
Please give an explanation on a separate sheet if you cannot provide 6 items; if the documents are not addressed to both of
you; or if they do not cover the 2-year period. If you and your partner lived with relatives or friends for some or all of the 2-year
period, please provide a letter from the relative(s) and/or friend(s) confirming this.
If you did not live together for any part of the 2-year period, tell us the reasons for this and whether you stayed in contact with

You must show cohabitation proof. A joint letter or letter each for roughly every 4 months of the last 2 years from a total of at least 3 different sources.
