Yet another 90 day concession query

Hi folks,

I've spent the last couple of hours reading through various posts on the 90 day concession for ILR from entry clearance. I don't think I've found one that necessarily matches my circumstances. My key dates are:

Entry clearance (Tier 1): 13 Jan 2009
Entry date: 15 May 2009
Current visa expires: 27 Feb 2014

So there are more than 90 days between my entry clearance and my entry date, and the guidance (on page 21) is pretty clear.

However, if I applied for my ILR on Feb 27th when my current visa expires, the difference between 5 years ago (27 Feb 2009) to my entry date is 78 days. Would that then qualify for the concession?

As you are over the 90 days concession, the start date of your qualifying period for ILR is your date of entry.
