Applying before 28 days on basis of 10 years residency

i am going to apply for ILR next month on the basis of 10 years residency. 3 years on student visa 2 years on PSW and 5 years on Tier 1.
The problem is I am still short of 2.5 months to qualify for ILR.
My question is -
if i apply for ILR now and if my visa got rejected on the basis of not completing legally 10 years of stay, what could be my options than ?
do i get the right of appeal ?
or HO will extend my visa temporarry till i complete my 10 years ?

Any inputs in this regard is greatly appreciated

Don't you qualify for ILR after 5 years on Tier 1?
