Applying for my ILR - which category do I fall under?

Hi there,
I came into the country under Tier 1 (General) and now I'm doing my form, I'm not sure if I fall under
- Tier 1 (General) migrant (excluding applications applying under the terms of the HSMP Forum Judicial Review Policy Document)
or
- Tier 1 (General) Migrant applying under the terms of the HSMP Forum Judicial Review Policy Document
I first got my Tier 1 around Jan/Feb 2008 and I believe it was under Tier 1. Would this mean that it's the first option?
