ILR Application -- 28 days criteria confusion

Hello everybody,

I am a regular visitor fo this froum since 2012.
Now the time has arrived for me to apply for ILR, so have got few questions.

My Visa details are as follows.

Initial Visa Stamp Date: 10. Mar. 09
Initial Entry Date: 13. Aug. 09

Visa Renew Date: 14. July. 12
Visa Expiry Date: 14. July. 14

Now if I calculate the no. of days from 14.July.2014 to 13.Aug.2014 it comes to 30 days, so I am outside the 28 days rule.

My Questions are:
1. Can I apply for the same day service may be around 13.July.2014.

2. Will there any possibility where any special consideration will be given in my case as I am only falling over by 3 days.

3. My understanding is that one can apply visa within 28 days afteer the expiry date of their current visa. So taking that that into consideration should I submit my application after 2 days of the expiry date i.e. On or after 15.July.2014.

4. If I take that route, will the caseworker reject my case stating that I am deliberately delayed my application to avail the Same daya service.

5. Lastly should I apply my visa by post -- maybe it's the safest way i think.

Any valuable advise/commensts will be much appreciated.

In PEO , you can apply only when your VISA is valid . As you are 3 days short you need an extension if you want to go for same day service or as you rightly said you can apply in post directly for ILR .

Thanks for your reply.
So if I apply by post, will the caseworker consider the date of application to count the 5 years or will they consider the date when they look into my application i.e. after my Biometrics appointment.
