Hi everyone

I have a one quick question re my wife's ILR. Spouse visa is valid from 14 July 2012 to 14 October 214. Could please advise when shall I apply for her ILR?

Catch date is 9th july 2012! In theory beyond this date she needs to be dependent for 5 years before ilr.
Hence any time in july 2017!

Spouse visa - do you mean the spouse leave as a PBS dep or ILR/British dep? When did you apply for the leave to enter, - exact date?

apologies forgot to mention that I had applied for her entry clearance in UK in September 2011 but it got refused and finally visa was granted on appeal. Therefore it comes under old 2 years rule i.e. before 9th July 2012 rule.

It was spouse visa for ILR (someone who is settled in UK)

When did she enter the UK?

She got visa on 14 July 212 and entered UK on 26th July 2012. Just re-iterate entry clearance application was made before 9 July 2012 changes and she was given 27 moths visa.

If I were you I'd apply for her ilr in june 2014, since she made her application before the rules changed.
She may be fortune to have it granted.
If not granted, nothing to loose apply for extension and then ilr in 2017.
The rules aren't straight forward sometimes. Do share your experience to help others.

Her visa is due to expire on 14 October 2014 would 28 days period not be applicable. i.e. to apply 28 days before visa expiry then we are looking at submitting application in September 2014. What is the reason of giving an extra 3 months at entry clearance stage?

Also, where you mentioned to apply in June 2014 and if ILR was not granted and if I am to apply for her extention would I have to pay again. You know much this all cost.

Hello Moderators - can you please advise it is a little bit confusing now. My understanding was that my wife would apply in September. Having read response from Apam I am not much sure.

28 days is from when you qualify ie 28 days from 14th July not when your visa expires! !!!
Any time you renew visa for extension, ilr or whatever you pay the appropriate current fees (your responsibility to know what the fees are, as it keeps changing).
Most spouse visas are given for 27 to 30 months generally.
I will encourage you to read ukba settled person sponsoring spouse from abroad. All this info and more are there. Will help you to understand the rules for your self.

She may apply for SET(M) between Saturday, 28 June 2014 and 13 October 2014.

The 27 months follows from TA ( Spouse – requirements for indefinite leave) Pakistan [2007] UKAIT 00011 > 19.

From 28 days before 26th July 2014, B1 English and LIUK required.
