ILR For spouse after 5 years in UK with 8 months gap

Hi All,

I got my ILR ,switched over from Tier1 last April.My wife and child came to UK in 2008 Feb and they had to go back to India for 9 months from Dec-2012 to Aug-2013.I am planning to apply for their ILR next month.

I believe I can apply directly for ILR as they were here for more than 2 years. However not sure any problems with 9 months recent gap.They are still under Tier 1 dependants visa.

Could you please advise if we can apply for ILR directly or apply for FLR?

I dont think there will be an issue with dependants absence, I am sure you can apply without any difficult.
