Urgent help needed plz. Very stressed.!

Hi members

I have been a silent reader of this forum. Now i have a problem and need to discuss it.I am here with my wife and 2 kids (2-1/2 years and 9 months old) born here.

I came to the UK on 12th March 2004. Since then all my applications were in-time and no adverse immigration history as well. My application for Tier 1 Entrepreneur got refused in February 2013 with right of appeal given. All my appeal rights,were exhausted on 28th February 2014. I applied for ILR (10 years) on 13th March 2014. I am a taxi driver and after submitting my ILR application, i thought that i still have the right to work until my ILR is decided. 2 days back i was stopped by the police and Home office officials and when the home officials checked my status they said that although my ILR application is under consideration, and because my appeal rights were exhausted, right of work also finished. I told them i never knew this as i thought i am still under section 3D. They gave me a letter saying that i have to report at the UKBA office every week with my family, but he said that my application for ILR will still be considered until a decission is made on it.

I am quite worried now. Will this effect my application for ILR.? will i loose all my 10 years.?

They are right, hopefully they'll not take any adverse action given the sincerity of the case. No more working until your ILR is granted.

Hi Amber

Thank you very much for your reply, i was expecting it. So this incident will not effect my application for ILR as it did not occur within those 10 years.?

Not related to this query, but can i ask if the time spent during the appeal process can be included for 10 years ILR application?

Yes, the time until the appeal determination can be included in the 10 years.

Hello Amber

So lets say the 10 years ILR is granted to ILR1986 user, but what will happen to his family? Will they have to go back and apply again or can they also come under 10 years ILR as well.

Hi MOnty Singh

My kids were born here so they will get Citizenship automatically once i receive my ILR. with regards to my wife, she has applied for a dependent visa on my behalf, so her application is on hold untill mine is decided.

Your children will not get Citizenship automatically, they will however, be entitled to register as British by virtue of section 1(3) BNA on form MN1 as soon as you are granted ILR. A dep may apply for FLR(M) asking for a decision to be made after the partner's SET(LR) decision.
