Esteemed members,
I am currently on my 2nd tier 1 expiring June 2016, I can however apply for ILR under 10yrs rule in Sept 2015. I have a child born in 2007 i.e. 7yrs in Sept 2014, my partner (child's mother)'s Leave to Remain has expired due to non-renewal within 28days of Leave expiry.
Now since my Leave to Remain is active, can I register my child for citizenship when he turns 7yrs? Thank you

No, the child will be entitled to register as British when you are settled (granted ILR) or when the child has been in he UK 10 years continuously since birth (but for short absences).

The child's Mother may be able to apply for FLR(FP) or, if she's overtayed less than 90 days, perhaps voluntarily leave the UK and apply for PBS dep leave to enter?
