ILR for Dependant for gap on visa continuity

Hi,
I am applying for ILR on Tier-1 General route this year, I have a query regarding applying ILR for my wife and daughter.
Me and my wife got Tier-1 General (3 years) visa on December 2009 and I had extension in UK on November 2012 and my family applied for Tier-1 General dependent extension in India on December 2012, they got refused on February 2013 for not submitting bank letter ( they have submitted bank statement on bank letter headed paper for only last 30 days reset of the statements are original and not included bank letter). My wife and my daughter again applied in May 2013 and got visa.
Since, they have gap on their visa continuity, please advice me, whether can I apply for ILR together with my application or do I have to apply for them PR dependent visa?
Also, please advice me - whether my wife application fall under five years route or two years route as the most recent entry clearance granted in India on May 2013?
