Another extension before ILR?

Dear All,

First of all thanks a lot to all contributors who is sharing lot of helpful information.

I was granted Tier 1 General visa on 25-Mar-2010 and I extended it on 05-Mar-2013 till 05-Mar-2015 (old Tier 1 General rules of 3+2). My question is how early I can apply for ILR? is it 28 days before 25-Mar-2015? Or do I need 20 days extension before I can apply for ILR?

Is there any guidance available about contracts extension beyond visa period? Currently an employer I am dealing with is saying if my contract expires in Jan-2015, they will not be able to extend it for the next 6 months because my visa expires on 05-Mar-2015, despite reassuring that I will be getting ILR after 05-Mar-2015.

And if the work contract ends on 31-Jan-2015 and suppose does not get extended, will it be an issue for my ILR? I can submit 12 months salary slips till 31-Jan-2015 without any issues.

You can apply 28 days before 25-03-2015.
you have to satisfy the points on earning by showing the income of 12 months in previous 15 months. So i think u should be ok even if the dont extend the contract.

Thanks a lot iworker. Also, if the contract does not extend beyond 31-Jan-2015, and if I satisfy 12 month salary requirement within last 15 months then is it ok not to have employment at the time of application? or will I be disqualified?

For Tier1 I dont think you need to be submitting paylsips ( UKBA doesnt bother ) as long as you have sufficient funds in your bank for you and for your dependants.

because Tier1 General is not tied to a employer...you can work for anyone and you can be off between contracts.

Hi Vijay,

Thanks for your response but I a sure for ILR from tier 1 general last 12 months payslips are needed.

My main concern is if my contract ends in Jan 2015 and does not get extended due to my VISA expiring in Mar 2015 (although after expiry of my VISA in march 2015 I will qualify for ILR, agents and companies do not extend contract beyond visa expiry date) I will not have job in hand at the time of ILR application. Is that ok? Or do I need to be in employment at the time of application?

Correct me if I am wrong. If you are applying for ILR you will apply before 28 days.

28 Days before Matrch is before end o Feb..so u will not have Payslip of Feb..U will have only till Jan. So I dont think it should be a problem.

However better take opinion from senior members.

You don't need to be employed to apply for ILR as long as you have completed 5 years lawfully in this country and also it's due to your visa type. Tier 1 visa don't need you to show any employment related details while applying for ILR. You
Just need to submit standard documents like 12 months
Months salary slips etc
