45 days short

i am on hsmp visa but I enter after 90 days in uk and now I have 45 days short to complete my 5 years time in uk can some one tell me if I can apply for ILR or extension
Per the guidance issues by the Home Office for excess absences, 450 to 500 (I think) are waived automatically upon your application for Naturalisation. I can't see why they would make an issue of 45 days when applying for ILR.
It would be best to call the Hoe Office though. They are very helpful.
