ILR + Tier(1) Dependency + 250 Days outside Uk

I have the following questions please ..
(1) Can the main applicant ALONE apply for ILR while the dependent continues to enjoy the Tier(1) dependent visa?
I have stayed outside country for 250 days in last 5 years.
I do not have reason for some period outside the country.
(2) Tier1(dependent) visa was acquired around June 2012 ; Entered Country in December 2012 - Can the Dependent Apply for ILR in November 2014? ( 28 days prior to qualification?)
