ILR: When to apply if total time is 15 days less than 5 year

Hi,

I am currently in UK on Tier 1 (General) which was first granted on 15-05-2011. Before that I was staying on PSW visa which was valid till 31-07-2011.

Based on first issued date, I will be eligible for ILR on 14-05-2016. But when I applied for extension in 2013, I applied 28 days earlier because process time was 4 weeks. But they did not took much time to issue visa and extension was issued on 30-04-2013. Due to this my current visa is expiring on 30-04-2016. So if we calculate end date (30-04-2016) minus first issue date (15-05-2011), it is 15 days less than 5 years.

I am confused about when to apply. Can anyone please answer my following question to make things clear for me.

1. Can I still apply for ILR as they stated that we can apply 28 days earlier. Or I have to apply for the extention first?

2. If I can apply for the before 28 days of 15-05-2016, can I send application by post after 17-04-2016. It will save me £1200 because I have two dependants as well? Apply in person costs £400 per person more.

3. My wife joined me as my dependent in April 2012. So she will be living with me more than 2 years when we apply for ILR so she has to be with me from 5 years?

You are eligible to apply for ILR anytime on or after 17th April, so you are easily within the limits of your current leave.

Thanks for your reply. I was bit concerned about it. Could you please answer 3rd question as well?

I agree with the earlier poster, however, since 17th Apr is a Sun, the earliest you can apply (I assume in person) is 18th Apr '16.

Thanks, I want to avoid "apply in person" because then I will have to pay 1200 extra for myself and two dependants.

Can I apply by post as well, if I apply on or after 18-04-2016?

thanks everyone.

Your suggestions really helped me to understand. I believe everything will be alright if I apply by post on 18-04-2016. As it will be well under 28 days and apply by post will allow me to save £1200 as well.

Dear pshayer,

You can apply by post. But I want to make you aware of waiting times. At the minute, it can take between 12-52 weeks. One of my friend applied 6 months back and still waiting....There is plenty of backlog in UKBA now..Final decision is your's.

Hi Arun, thanks for the information. In that case I think need to rethink. I don't mind if they take 3 months but I will be worried if I have to wait more than that. However, my case is very straight forward, I don't see any complication there. But if it is going to take over 3 months time, I think for peace of mind, I would prefer paying extra £1200.
