Firstly I would like to thanks everyone who contributing and clarifying with their wide range information on this forum.

Also please accept my apologies if my question or similar that is anywhere in this forum as I could not see what I was exactly looking for.

I am the Non EEA citizen wife of a British citizen. My first official application of Marriage Visa due to get married with my husband in UK was issued on Feb 2012, therefore; we have got married in the UK in April 2012.

My another application was for Leave to Remain (not ILR), was sent by ourselves to the Home Office before 9 July 2012 and received back as approved for 2 years permission of residency and work in the UK after 9 July 2012. (Valid from Sep 2013 till Sep 2015)

1- Am I affected by the rules came on 9 July 2012? I mean when do I have to apply for ILR
2- Is there any negative affection because of my unemployed status as I was a housewife and have never been worked but supported by my husband in the UK

I know there are lots of information regarding to my questions but I am really confused with the submission and approval dates of my 1st question.

You are under the 'old rules' pre 9th July 2012 which mean that you can apply for ILR 28 days before your current visa expires.
Bear in mind that you will need a pass in the Life in the UK test and B1 level English. You won't need to meet the £18,600 minimum earnings condition, you'll just have to show that you are able to support yourselves financially without claiming Public Funds. It doesn't matter that you're not working.

I am currently holding a residence permit and due on 5th of Feb 2015 therefore am going to apply for ILR. I am a non EU citizen married with British citizen.

I am planning to apply ILR on 16th or 23rd of Jan 2015. UKBA's website indicates that application must be made no more then 28 days before the expiring date of residence permit I currently hold. By the way I am on 2 year period. Would it lead to any unintended consequences, such us refusal because of the application was left too late, even though it was made still within 28 days time period? For example would it be a problem if I apply 14 days before the date of visa I'm currently holding expires?

I would also like to include my documents I will submit into my post.

- Passport + copies (myself and my partners)
- Residence permit card + copy (myself and my partners)
- Passport photos (myself and my partners)
- Filled application form
- Marriage Certificate + copy
- ILR Payment receipt
- ILR E-mail confirmation
- Knowledge of language and life in the UK test + copy

- Partners birth certificate + copy
- Partners bank statements last 3 months + copy
- Partners payslips last 3 months + copy
- Partners contract of employment + copy
- Partners P60 & P45 + copies

- 2x Tenancy agreement in both name + copies (we lived together in 2 different property)
- Letter from both mine and my partners bank + copies
- Utility bills in both names partially covering 2 years + copies
- Letters from NHS in both address we lived in 2 years + copies (myself and my partners)
- My regular email conversation with my father in law
- Our facebook prints
- Local supermarket membership card with letters + copies (myself and my partner)
- My partners credit card bills
- Photos of us
- Letter from both of us
- Letter from my college + copy
- Letter from marriage registration office (in both name) + copy
- Holiday flight ticket + copy
- Letter from my parents in law (which confirm that we living together and our marriage is accurate)

I went to my home country for holiday and was out of money so my partner transferred me some by western union money transferring. I also sent some money to my dad by western union. Should I include them too? Should I also include job applications I made? Do I still need to obtain a letter which confirms we living at this address from my GP if I already have regular letters from hospital?

Is there any exaggeration in my document list or any that I must include more?

My leave valid till 05 Feb 2015

You may apply for SET(M) no sooner than 28 days before your leave's expiry and preferably before your leave expires.

thank you for your reply. would it be any problem if I apply 1 or 2 weeks before then my leave expires? Is there any limitation about latest time I can apply before my leave expires?
