Hi,
I am due to apply for my ILR until 01 May 15 after completing 5 years period on Tier1 General
My wife applied for PBS dependant under tier1 on 27/08/2012.
Issued on 11/09/2012 until 01/05/2015 ( 2yrs 8months)
Came to uk on 21 sep 2012.
Please advise me for the following..
1) Can I apply her extension along with me on set(o) form and will it reset her 5 years ILR eligibility due to change of category on her visa from tier 1 general dependant to ILR dependant?
2) Can I apply her extension on pbs tier 1 dependant?
3) Can I use FLR(M) for her extention?
Please advise me the correct route considering future extension and ILR.
Thanks in advance

Hi I think she can apply as tier 1 general dependent along with you in a separate application ,recently my friend done the same thing she got more 3 yrs extension
All the best for ur ILR

If you apply on flr(m), it will reset her ILR clock to zero. Better to apply for pbs dependant extension until she meets the 5 year requirement.

Note that you will have to pay the new NHS surcharge at point of extension, £200 per year payable upfront.

Thanks Vijaya reddy for quick response... I have mixed reviews for the same. Some advising as you did and some saying to apply with me. If applying at same set(o) form doesn't reset her 5 years ILR eligibility than it seems better to apply together. As I don't need to take separate appointments..

She cant apply with ypu on set o if she does not meet either the pre july 2012 rule of 2 years residence or 5 years residence. To apply for pbs extension you need two seperate appointments (hers after yours on same day) and she needs to complete the pbd dependant form. She needs to pay the NHS surcharge (£600) in addition to extension fee and booking fee for in person appointment.

Contact the helpline. It might be ok if you explain the error but there is no guarantee. She is applying in a completely different category to you on a different form and a different fee.

Booked appointment: fees April 2015

I would think you need to book another appt for pbs extension. Contact the booking helpline tomorrow.
