Hi, I am due to apply for ILR based on 10 Years Long Residence. I am currently on Tier 1 Entreprenuer. My question is, when I apply for ILR next year based on 10-years, will my wife and my son also get ILR? My wife joined me back in 2008 as my dependant and my son is 5 years old.

Hi, I am going to apply in-person for my ILR based on 10 years long residence. I entered the UK on 17/02/2005 and my entry clearance was issued on 01/02/2005. My current tier 1 visa will expire on 10/01/2015.... My question is, I can apply 28 days before my 10 years completes. Does it mean 10 years after entering the UK which is 17/02/2005 or 10 years after the entry clearance date which is 01/02/2005..

I would really appreciate your guys help.

Hi, I am applying for ILR based on 10 years long residence. My wife is going to apply for FLR (M).

My question is, Our children, can they apply for naturalization direclty through MN1 or they will have to apply for FLR (M) aswell?

If the children were born in the UK, then they will be entitled to register after you are granted ILR. Else, they should switch to FLR(M) with other parent. The UKVI may expect you to satisfy the extra financial burden for non-British, non-settled, children.

Hi, I will be applying soon for my ILR (10 Years Long Residence), here is my current situation.

Entered the UK: 17-03-2007
Current Visa Expires: 10-02-2017

Total time: 9 years, 10 months and 25 days

As you can see I am short of 7 days if I am to apply 28 days before I am eligible.

Shall I apply for ILR (PEO as I don't want to wait for WEEKS) or apply for FLR FP (and defer through PEO)?

You cannot apply for ILR LR in person unless it is within 28 days of meeting the residence requirement. You will be refused if you apply in person too early.

Here is my new plan,

Apply for FLR (FP) for me and my wife (not for children) and then vary at PEO to Set (LR).

Is that oK?

You can only apply for ILR within 28 days of reaching 10 years.

Your choice what you do but HO does frown upon frivolous applications to 'buy time'.

And what application will your wife make assuming your ILR is successful?

Also, FLR(FP) posted means that there is a high chance that you won't get ILR decision on the day as PSC won't have your documents and will have to request them from wherever they are.

HO have certainly clamped down on the abuse of the FLR(FP) or FLR(O) 'buying time' applications.

How about submitting an application for Tier 1 (E) extension and then varying to Set LR?

Hi, I will be applying for Set LR in a few days, I am just submitting my application (Set LR) and spouse (FLR M) but I am not submitting my children's application as they will apply for MN1 form.

Now, I have seen a few posts from other users who have received letters from HO that tell me whereabouts of your kids?? What is the best way to mention this in the covering letter to avoid dealy?

Are your children UK born?

If yes, then write a letter to explain the children are UK born and you will be applying for MN1 under Section 1(3) of the BNA once your ILR is granted.
