FLR(m) instead of PBS dependent as PBS very expensive

Hi Guys,

Sorry if this questions was answered before, need clarification

I am applying for ILR form SET(o) next month from 5 year Tier 1 general route, my wife has joined me in UK just couple of months back as my dependent (Tier 1 general dependent).

My question is as my wife is not eligible for ILR, can I use FLR (m) form for her instead of PBS dependent after my ILR is granted (I am applying for ILR in premium service hopefully I should receive my ILR Biometric card with in 1 week then I will apply for my wife FLR(m) in post). I have read in other posts that FLR(m) will reset the clock to zero but that does not really matter for my wife as she has been in UK for couple of months till now even if it does resets to zero not a problem, The main reason for going for FLR (m) is as PBS dependent is very expensive for me(1736 + 600).

If the answer is yes she can go for FLR(m) now then after 2.5 years does she has to apply for FLR(m) again for 2.5 years to complete 5 years for ILR or if not how does it work?

Was your wife's leave granted for over six months?

My wife's Tier 1 general dependent valid from 03/12/2014 to 13/08/2015 but she came to UK last week of feb 2015.

the answer to vinny's question yes she has been granted visa over 6 months but from the time she arrived in uk to visa valid date its under 6 months

She should be okay with respect to E-LTRP.2.1(b ).
