this query is for my friend who is not able to come on this forum

his 10 years gonna complete in august 2015. he got his visa on 26 july 2005 but came in the uk on 7 august 2005. now his question is what will be his starting date towards 10 years ILR? he was on student visa through out these 10 years except 2 years on PSW. he is on the student visa at the moment. his second question is his college revoked and he has got curtailment letter till 5th july 2015. if his starting date towards 10 years started from 7th august then he will be eligible to apply for ILR on 9 july 2015 but his curtailment is going to finish on 5th july 2015. will he get 28 days grace period in this situation as he needs only 5 days?

The qualifying period for Long residence starts on the date of first entry.

Tell your friend to apply flr fp visa before 5th july than Vary it to set lr when he is qualified for ILR 28 days early. In your friend case 10th of July.

When he Vary his flr fp to set lr they will refund his flr fp fees. Pay full fees of ILR. dont pay the difference as stated in HO guidance. Some caseworkers dont really bother to follow their own guidance and can invalid the set lr if u dont pay full fees.

thank you zee ali. kindly tell me that can he vary his flr fp fee to setLR premium service. if not then how long postal application takes to get a result ?

one more question comes in mind which is his curtailment leave will finishes on 5 july 2015. will he get 28 days after 60 days finishes? normally when our visa finish, we get 28 days after the last date on visa. HO count it overstay days but it doesnt break 10 years ILR. can he do that ?
