3 months and a few days short of my 10 years...

hello everyone,

i have applied for set LR already and was looking for some further advise..

i was granted visa on 22 july 2005
i came to the uk on 27th august 2005
my current leave expired on 17th april 2015 ( applied for set LR on the 16th of april )
biometrics done 5th june 2015

1- when would have i actually qualified to apply for set LR ? is it 28 days before the date of entry or 28 days before the visa was issued?
2- what happens if i pass my 10 year qualifying period and my application is still in process ?
3- what happens if application is refused ? would i be given the right to appeal ? if so what should i do next ?

any advise or someone who has been through similar situation and would like to share their experience it would be greatly appreciated.

For Set(LR) applications it is calculated from the date of entry to the UK and NOT the visa start dated. You only qualified for ILR no sooner than 28 days before 27th August 2015.

u can apply 28 days before completing 10 year..so ur date is 25 July...if u dont get any decision by then i think u should be fine...otherwise should apply again within 28 days of decision. u should have applied for Flr fp not Ilr

hi ,

i have given my bio metrics on the 5th of this month and still have not got a reply. And i did consult a few people before and in the end applied with the help of a solicitor. Now praying and hoping for the best as my 10 years will complete by the end of july and if the decision is not taken by that time i hope im okay with everything else.

thanks tajammul77 for your kind reply .. really appreciate it .. i know i should have but unfortunately sum one advised me to straightaway apply for set LR .

Please note that: 28 days before 27th August will be 30 July 2015 and (not 25 july)

Hi Sameer0778866,

Please keep us posted about the progress of your case.As there are many people in the same situation including my self. I would have done the samething as you but would have delayed my bio for at least two invites to buy some time.

Nevertheless your only option now is to pray that ur case doesn't go the case worker before August.

hello everyone,

sorry that i have not been able to post a reply for a while now as i have not been very well. I still have not heard anything from the home office yet and as soon as i do i will definitely get back to you guys on what the decision was on my case and what steps i am going to take next with the help of my solicitor if the decision does not go in my favor.

please keep me in your prayers as i hope and wish the best of luck for everyone else in the same situation.

hi,

just wanted to update you all. there still has not been any reply from the home office and its been more then 3 months now since my bio-metrics were taken. So i am getting a bit worried and anxious at the same time.
wanted to ask you guys something. is it possible for me to withdraw my application and go for premium service now as i have already gone past my 10 years ? is that even a possibility?

any ideas and suggestions are most welcome.

hello everyone,

A quick update on my case. i received a letter today from the home office saying that and i quote

"we aim to process all applications within the 6 months from the date submitted. however in certain circumstances this target is not possible. following our assessment of your case unfortunately it appears your application will not be processed within the 6 months. we expect to make a decision by 16th January and we will write to you again if that is not going to be possible "

I just wanted to ask if anyone has been in a similar situation where they have got this letter and have had a decision before the end of the extended timeline they have provided ?

And also my bio metric was delayed is this the reason why they are doing this with my application ?

Is there any other way other then waiting to deal with this stressful period of wait so i can get a quicker decision ?

ANY input would be highly appreciated.

looks like your application is not a straight forward one, i think they will take their time in making a decision.

Hi Sameer,

You are not alone in this situation. I read a post where a PEO application is held because the case was not straight forward. The guy even vary the application to get a quick decision but that application was also put to hold. You should wait and hope for the best in my opinion.

Bye the way why and how you have delayed you biometric s? UKVI did'nt invalid your application?

hi ,

i don't understand how complicated an application can be that will take more then 6 months to decide. Anyway regarding the bio metrics i did not get any invitation for it when i called them they said it has already been sent out and they will send me another but the letter i got mentioned that i have failed to register my bio metrics within the 15 working day time period so my case is most likely to be not decided within the 6 month period which is what i am thinking they are taking their time to decide on my application. i have had couple of refusals in the past too but all my applications have been in time and i have never over stayed or been out of the UK for more then time allowed.

lets hope and pray for the best because looks like all i can do is wait at the moment. Would my solicitor writing a letter to the home office help in anyway ?

I got my ILR granted on the 12th of january after a 9 month wait. A bit late in updating as i was on holiday for a long time and just got back. Thank you to Almighty ALLAH and people who prayed and supported me and to the people who helped me out on this forum . i hope everyone who is waiting to get their ILR get it soon too.

Glad to read your success story, you applied for ILR almost 3 months before you were eligible and still got ILR. Congratulations.
