Tier1 to ILR with foreign income

Hi guys, i m about to applying for IRL in june.

Straight to point.

Had my Tier1 g approved in 2012-13, had showed foreign income as self employed and employment in UK. Now my question is do i have to worry declaration of foreign income as SE in UK, as on PEO HO gives SE questionnaire form to fill in from 2009 till 2014.

I was not registered on SA that time, and was on student visa prior.

Please reply anyone with valuable feedback and with same case?

On what basis are you applying for ILR, 10 years long residence?

No i m applying on 5 years complition of tier 1 g.

You need to declare foreign income in UK if you were tax resident in UK, which you must have been. DTA would even it out so you wouldn't be paying tax twice but it's an area for a specialist.

If your Tier1 G got approved in 2012 or 2013 how have you completed 5 years? Also in your Self assessment you need to declare income from all sources including any foreign income. If you have not then its asking for trouble. Do declare it now as you have got time.

HI,

I think better look at rules for taxation at GOV.UK. To declare foreign income you should be resident as well as domiciled in UK. If your economic relations are closer in your home country then no need to declare self employement. The below is from GOV website regarding tax on foreign income:-

" If you’re UK resident, you’ll normally pay tax on your foreign income. But you may not have to if your permanent home (‘domicile’) is abroad. "

Tax if you’re non-domiciled
You don’t pay UK tax on your foreign income or gains if both:

they’re less than £2,000 in the tax year
you don’t bring them into the UK, eg transfer them to a UK bank account

I hope this will give you a bit idea.......
