Deception

Hello senior gurus and all the members,I need your valuable suggestion please !!I few years back (2014)when I was working ,I use forge document to obtain work ,and at the time of student visa extension ,home office finds out I was working using my NI ,they contacted my work place and my student visa was rejected under 322(5)so with the help of solicitor ,I am fighting for my case and my 10 years is going to complete in 20 days time .As I haven't done any deception to HO ,my solicitors think I can apply for ILR and he is sure I got chance of getting indefinite .What are your views on that ??Do I have a chance or my solicitor is just after my money ?
I know I was wrong that time but I need to work to survive in this country as I didn't have no working rights in my biometric card .

What do you mean by you 'haven't done any deception to HO? The HO revoked your visa due to deception & false document under 322(5). Have you been in the UK illegally since 2014?

Do you mean 10 years LR?
'Fighting' on what grounds? you don't appear to have a leg to stand on.

But you have breached immigration regulations by breaching visa conditions!

- its unclear which bit of 'no working rights' was not clear to you.

In the event that you may not be aware of the grounds for refusal under 322(5):
322(5) It is undesirable to let an applicant stay because
of their character, behaviour or associations
(including convictions which do not fall within
paragraph 322(1C)), or because they are a
threat to national security.
The only gain from your 10 year LR application will be your solicitor's bank account.

They give me rights to appeal so no I am not staying illegally.my case is still pending in court .My solicitor suggest to me to apply indefinite in the basis of 10 years long residence.

Yes I know I have breached regulations .But I haven't given false documents to HO ,just to work place .

Has your case been pending since 2014?
If you want to apply for Long Residence you will have to withdraw your appeal first. Your solicitor should have advised you of that. However, this means that the refusal under 322(5) will stand for an application under LR. It doesn't miraculously disappear.
You admit that you worked under forged documents in access of your permitted hours as a student, so what defence did you submit for your appeal?

Yes my case is still pending . Firstly HO rejected my student visa saying I have given forge documents with my application which was completely wrong ,went to court and home office withdrawn there case .After 2 months they send me new rejection letter quoting my working hour,forge documents provided at work place ....Now I have passed
two years already and will complete 10years legal stay very soon .Anyway I have decided to apply LR eventhough I got slim chance .What surprise me is my solicitor is confident i will get LR as I haven't given forge documents to homeoffice .

Then who gave the forge document to Home Office if not you?

I think that Facebook507 is under the misconception (or his solicitor is), that as he 'handed the forged documents' to his employer and not directly to the Home Office, he's in the clear.
I guess that the solicitor wouldn't be so confident of the application succeeding that he'd take the case on a '
no win, no fee' basis!

Agree. If you withdraw or lose your appeal, then they will
likely refuse any subsequent application on the same grounds.

Employer may feel a little aggrieved too, being liable and (nowadays) subject to punitive fines for entertaining illegals.
And, depending where employer sits on the 'dodgy-employer scale', one wouldn't want to upset the employer.

I was in the same situation as you mate, took 5 years to fight for my case. Luckily by that time my son was 7 years old and due to this reason they granted me 30months visa (route to settlement).
Are you married? any kids born here in UK? You may stand on human rights ground.
No need to submit ILR application as they will definately refuse.
