ILR Questions - Traffic Offence and Qualifying Period

Hello guys,


I have got 2 queries.

1. Traffic offence impact on ILR (court imposed fine)
2. 5 year calculation.

Traffic offence impact on ILR (court imposed fine).
I did the traffic offence and court imposed 3 points and £400 fine- date of sentence 13/09/2012.
I had already declared it in my last extension and will declare it in my ILR as well.
I have already requested SAR and it will take 40 days.
I am applying for ILR on 15th October will this impact my ILR ? also can you please suggest what supporting documents should i take with me for this issue and should i mention it separately in my application letter ?
i do understand that general ground of refusal is if i apply within 24 months of conviction.

5 Year Calculation:
I got my Visa some where early 2010.
I first entered UK 24 Sep 2011 on Tier 1 general Visa for a Job interview.
Left UK after 1 week and continued my Job in Kenya
Got job offer and came back UK on 11th of Nov.
Joined Job on 14th of Nov.

My question is from which date -28 days i am eligible to apply for my ILR and claim my 5 year period.

I would really appreciate your help in this regard, i am struggling to find the correct answers

Hi Elf,

1. with regards to your traffic offence you should definitely be fine as the guidance stipulates that they should have been spent 24months prior to application which is way over anyway and just make sure that this is declared or else that will lead to a refusal.

2. Also as regarding your absence of 1 week from the UK, you should also be fine as long as you have also met other criteria which stipulates that you have had no absence of more than 180days in the years preceeding your application. Just make sure that you get an employer letter for any absences no matter how little the days are. this is considering that most of the case workers will request for this as part of the application.

for the guys to be able to help with when you can apply you will need to list your timelines on here as to when was your initial grant and when does your current tier 1 visa expire.

1. For Offence: should i mention it in my application letter as well?
for supporting documents i have court memorandum, SAR ( requested) , DVLA online print showing points have expired/removed). anything to add?

2. For 5 year Calculation:
I am planning to apply PEO on 15th of October 2016, my current Tier 1 extension will expire on dec. 2017.

My 5 year calculation is based on date 11 Nov. 2011 -28 days which is 14.Oct2016. Reason i have selected this date as i arrived UK with employment and started living in company accommodation, so i am fulfilling the clause which is (applicant must be contributing in UK economy during the period of 5 year claim and employed). I hope i clarify where i am coming from.

is my selected date of 15 Oct2016 good to go for ILR? as i started Job on 14th of Nov.:(
