Hi,
The qualifying salary should either be 35K or minimum required for the respective SOC code (whichever is higher).
Your friend needs to verify that his SOC code respective salary is 35K or less in order to meet ILR conditions.
Thanks,
Hassan

See page 96 onwards in the link below. The requirement is that a Tier 2 Migrant must earn £35k to be able to apply for ILR. This requirement came into effect in April this year.

Thanks CR001 for the updated info.
There is still little confusion. It also says that the employer must be paying the appropriate pay for that SOC.
Let say if a person has SOC 1234 and appropriate salary for this code is 40K then should not the employee be earning 40K at the time of ILR?
Thanks,
Hassan

Must earn a MINIMUM of £35k. Obviously a migrant can earn more.

Minimum salary requirement is £35k, but if your job code states that your minimum salary should be £40k, then that’s the salary you should be earning.
For E.G (1) a job code 1234 minimum salary is £32k – The applicant should STILL earn at least £35k for ILR
(2)A job code 5678 minimum salary is £40k – The applicant should earn at least £40k for ILR
