ILR after 2 and half years descretionary leave

Pls i need advice urgently!!!!!!
i came to the UK in 2007 on a spousal visa to an HSMP visa holder. the relationship broke down along the line and i was denied my ILR after completing the required 5yrs stay in 2012 for an HSMP holder but my ex-husband was granted his ILR.
As a result of this i kept appealing my case until 2014 when i was able to apply under the descretionary 7years child visa but during this period of appeal i was told i overstayed my visa by 1 day but i was able to argue it out at the upper tribunal and was granted the 2 and a half years visa.
I will reach my 10years long stay by June 2017 can i still apply for my 10 years long route by then pls? cos my lawyer says i might be affected by the 1 day overstaying even though i was able to appeal it then.
