My wife T2G dependent - ILR eligibility

Hi,

I would like to check what is the best thing to do in regard to my wife ILR. Her visa history is as follow,

Granted T2G dependent visa on 18/09/2012
Traveled to UK on 25/11/2012
no absences more than 28 days a year
Still on T2G dependent visa
Her current visa expires on 15/08/2017

I have obtained ILR this month.

When I did the calculations, I think I can apply as early as 28 days before 18/09/2017 - which will be around 23/08/2017, but her visa will expire just about 7 days prior to that.

1- Do i have to apply for an extention for her to complete the 7 days gap before I can apply for ILR for her.

2- Is there any way around that?

3- Is my calculations above right?

Your calculations are incorrect.

PBS Dependents qualifying period starts from the date of ENTRY to the UK and NOT the visa start date.

On what date did she APPLY for the visa?

On what basis did you obtain ILR, Tier 2 G 5 years or 10 years long residence?

I got my ILR after 5 yrs on T2G.

I didn't understand what you mean by the first question,
if you mean the current visa - from 15 july 2014

Here original visa in 2012, what date did she apply for it or submit her application?

I just looked that up, it was actually in mid august 2012 - so well after the 9th of July.

I think that makes her need to complete a full 5 years, before become eligible to apply for ILR.

My issue is her visa will expire few months before she complete 5 years.

what is your advice about this situation?

She will need to apply for an extension first.

In addition to the extension visa fee, the NHS surcharge will also have to be paid.
