10 year Long Residence Application Please Help!

Hi all,
couple of questions :
1. I entered the UK on may 2007 but visa was issued on march 2007.
my solicitor said i can apply my 10 year residency based on March 2007 but it will count as absence which really is within the allowed time of continues absence ? is she right?
2. Im currently on tier 1 entrepreneur I'm worried my application will be refused as i was working from time to time which i believe my employer was paying the tax. what will i do?
