Hi Please help me .My wife came on PSW dependent visa in May 2011. We switched to Tier 2 general in April 2012 and stayed on same visa(wife on T2 dependent). First stamped was for 3 years from 2012 to 2015. I changed employer in 2014 and stamped again for 3 years till Nov 2017. I completed my 10 years In September 2016 and applied for ILR in October 2016 which was granted. My wife still on Tier 2 dependent and her 5 years completed now on Tier 2. My daughter is British and have British passport born in 2012 in UK.

I want to apply for ILR for my wife can I do this on the basis of pre july 2011 rule(2 year) which my wife completed already. I did not changed my wife visa just in case to complete 5 years on Tier 2.
she has visa till Nov 2017 .

Please help if she can apply for ILR

Thanks
Saj

Please check the link below .

https://www.gov.uk/settle-in-the-uk/y/y ... ier-5-visa.

if you have applied for ILR on 5 year route as Tier 2 general then she would have been eligible to apply for ILR. the link says

If your partner or parent settled in another way, for example because they’d been in the UK for 10 years (‘Long Residence’), you can’t settle because of their work visa. You’ll need to apply to stay in the UK with a person settled in the UK .

she needs to apply for flr m , as u applied for ilr based on LR.
once she completes flrm 5 years or completes her own 10 years, she can apply for ilr.
