ILR(long residency)Query

Hello knowledgeable People,I will be completing my 10 years in U.K. By July this year(2017).I came to uk in July 2007 as a student and my wife join me as my dependant in April 2009.i have been on student visas without any break or refusal till may 2016 when I couldn't renew again due to the CAP limit. We therefore made a Flr (fp)application based on my daughters born in U.K.( 2010 and 2012) and the application was refused with a right of appeal in august 2016. We then made an intime appeal which is still pending. My question:is it possible to withdraw only my appeal when I clock 10 years ( as me,my wife and daughters)have different appeal numbers while the others continues with their appeal. Why I am thinking of doing this is because it's my wife that works to support the family as my last visa does not permit me to work and withdrawing her appeal will end her right to the work.I spoke with my solicitor and he said we can withdraw only my appeal but I want opinion from other knowledgeable people or people that have gone through that route so I wouldn't make a costly decision .Thanks in anticipation of your replies/inputs.

Yes you can withdraw appeal and can go for Premium Service once you complete 10 year's you can do that and your wife and child appeal can go ahead once you receive ILR then you can withdraw their appeal and can apply for FLR FP again as you can not work once withdraw appeal so you cannot apply FLR M.

Good day Everyone,just a quick question.if one has his or her appeal refused by the tribunal but completed 10 years lawful residence before the appeal determination,can he or she make an ILR (10 years) route within 14 days of the refusal.Thanks

Yes, time spent on section 3C counts as lawful stay
