No, but you need to provide and absence letter from each employer.

They asked my P60s and P45s. I broke my continuous period though. So just have it ready just in case.

You will need to show your P45 forms to prove you did not spend more than 60 days without employment.

HI Guys,

Thanks for your replies.

Why I need to show absence letters from employees? I thought that is only needed if I went oversees for work. But if I went for personal holidays I just need to mention that in form.

Also If I don't have P45 can I just show P60? Or my payslips for months which I changed the job?

You need to submit an absence letter from your employer(s) for ALL your absences from work for whatever reason. This is to ensure that your absences were in line with the purpose of the Tier 2 visa and with the permission of your sponsor.

That will be tricky to get from my old employers. If I take holiday allowance will that be fine? Or I need to show all the specific holidays which I have taken?

If the absences from the UK in a year were less than (public holidays + the statuary paid holidays) then the case worker can apply discretion, assuming they were in line with the purpose of your visa without any evidence.

Just state holiday or annual leave entitlement,

Beyond why members believe there is a "one size fits all" template for everything.

Can you please clarify - if I need to provide absence letter from the employer even if I have not left the UK?

Also I don't have a copy of my previous P60s/P45s? Can you please let me know how we can get the old ones?

I am due to apply for ILR in November.

Many thanks

HO is mostly concerned about all your absence from the UK or any long absence from work in general.

Thank you. I only took leave for about 16 days off (but stayed in the UK) during my employment time for about 5 months with an employer. Is this "long"?

Also how soon can we get the letter from previous employer? i.e. what should be the earliest date on the letter if I am applying on Nov 20, 2017?

I explained above that taking time off below the statuary limit is not an issue !! Your letter better be recent when you apply for ILR.

Sorry, I should have clarified that all the leaves were unpaid

I took 3 weeks of unpaid leave during this time. Am not sure if at all this unpaid leave was reported in the SMS portal. In the official guidance it says 4 weeks of unpaid leave is allowed per year (Jan - Dec) to not break the continuous period leave.

As I only worked for 4.5 months (5 days a week) with this sponsor will it impact the ILR decision? i.e. will the number of leaves be "pro-rated"? Have I broken the continuous period requirement?

Also, When I was on PSW I started a company in Jun, 2011, but was dissolved in Feb, 2013. My Tier 2 started from Nov, 2012 - so wondering if this impacts anyway?

Is there anything that we need to consider/mention to the casework (say in a cover letter) that the company I worked was acquired, and the new company later sponsored halfway through the visa term?
